1 Definitions

Company means Lift Right Services. Client means the individual, company, organisation or person purchasing services. Services means forklift operator training, examinations, LOLER Thorough Examinations, consultancy and associated services.

2  Booking and Acceptance

A booking is confirmed when a quotation is accepted, a purchase order is issued, or instructions are given to proceed. By confirming a booking, the Client accepts these Terms and Conditions.

3 Client Responsibilities

The Client shall provide safe access to site, suitable facilities, safe and serviceable equipment, and ensure candidates are medically fit and capable of operating equipment.

4 Training Services

Training will be delivered in accordance with current RTITB standards and industry best practice. Certification will only be issued where the required standard has been achieved. Certificates may be withheld until all outstanding invoices have been paid in full.

5 Thorough Examinations (LOLER)

Reports reflect the condition of the equipment at the time of inspection only. The Client remains responsible for maintenance, repair and ongoing safe operation of equipment.

6 Fees and Payment

Payment terms are 30 days from the invoice date unless otherwise agreed in writing. Lift Right Services reserves the right to charge statutory interest and recovery costs on overdue accounts.

7 Cancellation

Training cancelled with more than 5 working days’ notice will not be charged. Training cancelled within 5 working days of the scheduled date will be charged at 100% of the agreed fee. Lift Right Services reserves the right to reschedule services due to circumstances beyond reasonable control.

8 Health and Safety

The Client must provide a safe working environment and comply with all applicable health and safety legislation. Work may be stopped immediately if unsafe conditions are identified.

9 Limitation of Liability

Liability for any claim arising from services provided shall be limited to the value of the contract under which the claim arises, except where such limitation is prohibited by law.

10 Data Protection

Personal data will be processed in accordance with applicable UK data protection legislation.

11 Complaints

Complaints must be submitted in writing within 14 days of the service date.

12 Governing Law

These Terms and Conditions shall be governed by the laws of England, Scotland and Wales.
